1. Acceptance of Terms
By accessing and using MoodFire, you accept and agree to be bound by these Terms and Conditions. If you do not agree, please do not use the app.
MoodFire is operated by MOODFIRE LTD, a company incorporated in England and Wales. By accepting these Terms you are entering into a binding contract with a UK company. These Terms are governed by the laws of England and Wales regardless of the country in which you reside or access the app. See Section 14 for the full governing law and jurisdiction clause and the notice for users outside the United Kingdom.
2. Medical Device Disclaimer
MoodFire is a consumer wellbeing application. It is not a medical device, not a substitute for professional mental health care, and is not intended for the diagnosis, treatment, cure, or prevention of any medical or psychological condition. If you are experiencing a mental health crisis, please contact emergency services or a crisis support line immediately.
3. Use of the App
You agree to use MoodFire only for lawful purposes. You must not use the app in any way that causes harm or disrupts the app's functionality.
You agree to provide honest and accurate responses to wellbeing check-ins if you choose to complete them. Providing deliberately false or manipulated responses may result in misleading trend data that we cannot correct on your behalf.
4. User Accounts
When you create an account with us, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
5. Age Requirement
MoodFire is intended for use by individuals 18 years of age or older. By using the app, you confirm that you are at least 18 years old. If we discover that a user is under 18, we will terminate their account and delete their data immediately.
6. Medical Disclaimer
MoodFire is a wellness tool designed to support your mental wellbeing through mood tracking, breathing exercises, cognitive reframing, grounding techniques, gratitude journaling, and calming audio. It is not a medical device, and is not intended to diagnose, treat, cure, or prevent any medical condition or mental health disorder.
The app does not provide medical advice, therapy, or counselling. If you are experiencing a mental health crisis or have concerns about your mental health, please contact a qualified healthcare professional or your local emergency services immediately.
7. Subscriptions and Payments
Access to MoodFire may require a paid subscription. Subscription payments are processed through the Apple App Store or Google Play Store, and are subject to their respective terms and conditions. We do not have access to your payment card details. You may cancel your subscription at any time through your app store account settings.
8. User Content
You retain ownership of all content you create within MoodFire, including mood entries, reframe journal entries, gratitude entries, and any other personal data you input. Your content is stored securely and is not shared with other users or third parties. You are responsible for the accuracy and legality of any content you create.
9. Notifications
MoodFire may send you push notifications to support your wellness routine, such as mood check-in reminders. You can opt in or out of notifications at any time through the app settings or your device settings.
10. Intellectual Property
All content, features, and functionality of the app (excluding user-created content) are owned by MoodFire and are protected by intellectual property laws.
11. Termination
We may suspend or terminate your access to the app at any time for any reason, including violation of these Terms. You may also delete your account at any time from within the app, which will permanently remove all your data.
12. Wellbeing Check-Ins Are Not a Medical Diagnosis
MoodFire offers optional wellbeing check-ins based on the PHQ-4 and GAD-7 self-report instruments. These check-ins are provided for self-reflection and personal trend-tracking purposes only.
You acknowledge and agree that:
- MoodFire is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition.
- The wellbeing check-ins do not constitute a medical or psychological assessment, diagnosis, or opinion.
- Scores and trends shown in the app are not clinical judgements and should not be interpreted as such.
- MoodFire does not replace advice, diagnosis, or treatment from a qualified healthcare professional.
- You are solely responsible for seeking appropriate professional support if you are experiencing mental health concerns.
- If you are in crisis or at immediate risk of harm, you must contact emergency services or a crisis support line directly.
MoodFire may, at its discretion, surface supportive content or crisis support resources based on your check-in responses. This is a best-effort feature and should not be relied upon as a substitute for professional judgement or emergency intervention.
13. Limitation of Liability
MoodFire shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the app. This includes, but is not limited to, any reliance on the app's content or features as a substitute for professional medical or mental health advice.
Without limiting the foregoing, MoodFire Ltd accepts no liability for any decision you take, or fail to take, on the basis of wellbeing check-in results or trends displayed in the app. These tools are for self-reflection only.
Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded under the law of your country, state, or province of residence.
14. Governing Law and Notice for Users Outside the United Kingdom
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of England and Wales.
MoodFire is operated by MOODFIRE LTD, a company incorporated in England and Wales. By using MoodFire you agree that:
- These Terms form a binding contract with MOODFIRE LTD, a UK company.
- English law governs these Terms regardless of the country, state, or province in which you reside or access the app.
- You submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising from your use of MoodFire.
- Mandatory consumer rights granted to you by the law of your country, state, or province of residence are not displaced by this clause and continue to apply where they cannot be lawfully waived.
Notice for users in the United States and Canada. If you reside in the United States or Canada you acknowledge that, by using MoodFire, you are entering into a contract governed by the laws of England and Wales and that any dispute will be heard in the courts of England and Wales. Specific privacy and data-protection rights you may have under your local law (including the CCPA and CPRA in California, comprehensive consumer privacy laws in other US states, US state consumer health data laws such as Washington's My Health My Data Act, and PIPEDA and provincial privacy laws in Canada) are described in our Privacy Policy.
15. Changes to Terms
We reserve the right to modify these Terms at any time. If material changes are made, we will notify you through the app or via email. Continued use of the app constitutes your acceptance of the new Terms.
16. Assignment & Transfer
These Terms, and any rights and obligations hereunder, may be assigned or transferred by MoodFire (or its parent company, MOODFIRE LTD) to any successor entity, acquirer, or affiliate without your prior consent, provided the assignee agrees to honour the obligations in these Terms. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
17. Organisational Accounts
MoodFire may be made available to you through your employer, university, or another organisation under a separate agreement between MoodFire and that organisation. Where this applies, your organisation may manage certain aspects of your account, such as provisioning, feature access, and subscription status. Your use of the app remains subject to these Terms. Any data you create within MoodFire remains yours unless the organisational agreement explicitly states otherwise.
Your individual wellbeing check-in responses are your personal data and are not visible to your organisation under any circumstances.
18. White-Label and Branded Versions
MoodFire may be offered in white-label or branded versions through partner organisations. These versions are powered by MoodFire and subject to the same Terms and Conditions. Partner branding does not alter your rights under these Terms or the way your data is handled.
